DETAILED TERMS AND CONDITIONS FOR FIAT UPGRADE OFFER

• Fiat ‘Car Upgrade’ Offer on Punto or Linea includes –

Diesel Upgrade Offer; 1 year’s Fuel Voucher for 100 lucky customers with maximum value of Rs 54000 for any petrol variant & 26000 for any diesel variant.; 3 months Fuel Voucher for all customers with maximum value of Rs 13500 for any petrol variant & Rs 6500 for any diesel variant. Free FIAT Road Side Assistance, Savings on Insurance – jointly termed as ‘Offers

• ’.The ‘Offers’ are valid from 1st July, 2011 to 31st July, 2011 both days inclusive (hereinafter referred to as the “Offer Period”). Offers are valid for a Limited Period only and cannot be clubbed with any other Fiat Offer operational in the market during the specified period.
• Fiat India Automobiles Limited reserves the right to terminate, modify or extend this offer at anytime at it’s absolute discretion without assigning any reason.
• Employees & family members of Fiat India Automobiles Limited; Tata Motors; Tata-Fiat dealerships, Media2Win, Bates 141 Worldwide & Maxus , are not eligible to participate in this contest.
• Bookings made in June, 2011 but pending for invoicing and final payment/delivery will automatically become eligible for participation in the Fiat Upgrade Offer of July 2011. Customers need to use their existing Booking ID generated during June 2011 for participating in / availing the Fiat Upgrade Offer.
• Incase a car upgrade winner wants to stick to the original booking, he would be entitled to the ex-showroom price difference between the car variant booked and the car variant entitled.
• All customers shall be entitled to fuel vouchers according to the final car invoiced as per the Fiat Car Upgarde Offer.
• The Fiat Car Upgrade Offer is not applicable on Corporate / Bulk booking. However they shall be eligible to avail the minimum assured benefits as per the offer.
• Participation in the contest confirms acceptance of the Terms and Conditions governing this Offer.
• The contest website is being managed by Media2Win India Pvt. Ltd.

CONTEST TERMS AND CONDITIONS

• All offers are from authorized Tata – Fiat Dealerships across India.
• Participation in the Contest is purely voluntary – customers who decline to participate (option to be exercised at the time of booking) shall irrevocably forfeit all their rights provided under the Contest. Option once exercised shall be final and irrevocable.
• Eligibility for Participation: Customers shall pay the minimum booking amount as specified by the dealer and complete the sale transaction. (Making the full payment within 15 days and taking the delivery of the vehicle within 45 days from the date of booking).
• Customers opting not to participate in the contest will not be eligible for any prize. However they shall be eligible to avail the minimum assured benefits as per the specified offer.
• Any customer who opts not to participate in the contest, will be offered assured fuel vouchers with maximum benefit of Rs 6500 on purchasing any diesel variant of the Fiat Linea or Fiat Punto in addition to Free Road Side Assistance and Savings on Insurance.
• Any customer who opts not to participate in the contest, will be offered assured fuel vouchers with maximum benefit of Rs 13500 on purchasing any petrol variant of the Fiat Linea or Fiat Punto in addition to Free Road Side Assistance and Savings on insurance..
• Fiat Linea and Fiat Punto are also available without this Offer
• Offers are available only after participating in the contest. No cancellation is allowed after entering the contest
• Participation in the contest will be allowed only after submission of all relevant papers and documents by the customer before generation of the final retail invoice at the Dealership.
• All customers, by virtue of entering this contest, shall become eligible to receive future communication regarding the company products, contests, customer surveys on their cell phones and email and schemes from Fiat India Automobiles Limited. Fiat India Automobiles Limited may use the personal information accompanying the entries for the purposes of  promotion and for sending promotion and other material in relation to future offers, information and activities of Fiat India Automobiles Limited unless otherwise advised by the participant at the time of entry.
• The lucky customers agree to make themselves available for reasonable publicity purposes without compensation including but not limited to posing for photographs and giving interviews. All copyrights shall vest in Fiat India Automobiles Limited. The csstomers acknowledge that their personal details may be published in the newspapers and placed on the internet or any other print or audio/visual media.
• Tata-Fiat authorized dealers shall provide Fuel Vouchers through Indian Oil Corporation by issue of XTRAPOWER fuel cards that can be used at 6000 Indian Oil outlets across India, details of which are available on www.fiat-india.com/upgradetomultijet.com
• All customers shall be deemed to have accepted the terms and conditions of this offer by virtue of electing to participate in the contest.

CONTEST PRIZES:

• 20 Lucky Customers (on pan India basis), who win from amongst all the customers booking a Fiat Punto or Fiat Linea during the Offer Period will get a ‘Diesel Car for the price of a Petrol Car’ as follows:
• Lucky Customer booking a specific Fiat Punto Petrol variant who get ‘DIESEL CAR FOR PRICE OF PETROL CAR will be offered the corresponding* variant of Fiat Punto Diesel at no extra cost;
• Lucky customers booking a specific Fiat Punto Diesel variant who get the ‘DIESEL UPGRADE OFFER’ will be offered the opportunity to pay the price of the corresponding petrol variant of the Fiat Punto at no extra cost
• Lucky customers booking a specific petrol variant of the Fiat Linea who get the ‘DIESEL UPGRADE OFFER’ will be offered the corresponding* diesel variant of Fiat Linea at no extra cost

• ”Price” denoted the ex showroom price of the cars only, all other charges such as, but not limited to differential amount of registration, road tax, insurance, extended warranty, logistics, etc shall be borne by the winner.

Calculation of Fuel Expenses detailed below are based on monthly average running of 1000 Kms at a fuel efficiency of 19.91 for diesel cars and 14.64 for petrol cars. Cost of petrol has been assumed as Rs 65 pan India and cost of diesel has been assumed at Rs 43.

• Fuel vouchers value is calculated at 1000km/month average running by the customer. For calculating value on diesel vouchers a fuel efficiency 19.91 Kmpl is assumed. For calculating value on petrol vouchers a fuel efficiency of 14.64 Kmpl is assumed. Fuel efficiency for Petrol vehicles is calculated as an average of Fuel Efficiencies of BSIV Punto (1.2 L & 1.4L) & BSIV Linea (1.4 L & 1.4 L T Jet) as per rule 115 of CMVR. Fuel efficiency for Diesel vehicles is as per rule 115 of CMVR for BSIV Punto & Linea 1.3 Multijet Diesel variant.
• Fuel prices have been taken at an average of Rs.m 65 for Petrol and Rs. 43 for Diesel pan India and does not have any bearing to the actual price prevailing at the time of the offer or at any time during the offer period.
• All above assumptions are true at the time of the offer and are subject to change at a later date
• The calculations made above are representative of normal use and not representative for high use individuals. The benefit offered is the maximum amount eligible under the offer made by authorized Tata- Fiat dealers. The name ‘1 year and 3 months fuel offer’ is only a name to denote the nature of the prize and has no relevance to the period for which the fuel is provided and is subject to a maximum cap specified in the offer.

HOW TO PARTICIPATE:

• Customers should get a confirmed booking ID from an authorized Tata Fiat Dealerships against down payment towards purchase price of the Fiat Linea or Fiat Punto.
• The customers should visit www.upgradetomultijet.com with the help of dealer salesman / consultant from a computer at Tata-Fiat Dealership using the unique log-in id and password allotted to the dealership:
• Accept the terms and conditions
• Fill in the Unique Booking ID in the space provided correctly
• Fill in all other details required
• Correctly answer the contest question appearing on the screen
• Complete the a slogan ‘Fiat Diesel Drives India because..…’.
• Submit the entry.
• After entry is successfully registered in the system on www.upgradetomultijet.com, the system will display a few Fiat logos on the computer screen, from which the customers will select one logo.
• The corresponding applicable Offer will be displayed to the customer after the random logo selection. This page displaying the offer is the ‘Award Acceptance Document’. It must be printed out and jointly signed by the dealer and customer. A copy shall be given to the customer and another copy retained by the Dealership.
• The selection of lucky customers who get an offer will be through a computer generated random selection amongst all the correct entries received at a given point of time.
• The declaration of the applicable OFFER for each customer will be done by the dealership personnel in the presence of the customers.
• The final delivery of the Cars to winners of the ‘DIESEL UPGRADE OFFER’ will happen as per schedule confirmed by the Tata-Fiat Dealership at the time of invoicing and not immediately at the time of announcement of the Offer.

The Tata-Fiat Dealership, Tata Motors or Fiat India Automobiles limited and Media2Win Pvt. Ltd. will not be in any way held responsible in delay of delivery of the fuel vouchers to the winners of the ‘1 years Pre Loaded Fuel Voucher Offer’ and ‘3 months Pre Loaded Fuel Voucher Offer’.  The delivery time cannot be used as a pretext to cancel the booking by any customer or winner. The Tata-Fiat Dealership will make best efforts to deliver the same at the earliest.

• The applicable Car as per the Offer won will be made available to the winner with standard equipment and parts only irrespective of the add-ons desired by the customer..
• The Offers are subject to applicable taxes and duties under prevailing tax laws and regulations and shall be borne by the customers. The Offers shall be forfeited on the refusal to pay the applicable taxes and levies.
• All customers are required to retain the ‘Award Acceptance Document’ which is jointly signed by customer and Tata -Fiat Dealership personnel and will be required for verification after the random generation. Without the ‘Award Acceptance Document’ original booking ID, the company shall NOT hand over the Offer(s) to any customer.
• Entries without slogan and / or without answers to the questions will be automatically disqualified
• Decision of Company will be final and binding on all customers during for the  Offer .
• Tata-Fiat Dealerships. and Media2Win India Pvt. Ltd. shall not in any way be liable for any loss of data during non connectivity or while punching in the unique booking ID at Tata-Fiat Dealerships or any disruption or disconnection in the broadband connectivity that might occur at any point in time and all such disputes shall lie with the telecom service provider.
• All Offers are non-transferable and non–substitutable.
• The customer who participates in the contest needs to be the final buyer of the car.
• The Offers cannot be exchanged in lieu of cash.
• All the fuel vouchers are subject to the rules applicable to XTRAPOWER Fuel Cards issued by Indian Oil Corporation Limited and come with a validity period and must be consumed within the time frame mentioned and should not be presented before or after the dates mentioned. • All promotional materials, including details on how to enter and to claim the offers are part of these Terms and Conditions of Entry to this Offer.
• This offer is being made purely on a “best effort” basis and is subject to “force majeure” conditions, including acts of God, strikes, war, riots, change of law, statutory prohibitions / restrictions. This Offer cannot be clubbed with any other Offer / Scheme prevailing or offered at the Dealerships.
• The backend database accumulation and random coupon selection in relation to this contest is being managed by Media2Win India Pvt. Ltd. under the supervision of Tata Motors and Fiat India Automobiles Ltd. Media2Win India Pvt. Ltd. is engaged in the business of providing online assistance during the Offer period to Fiat India Automobiles Ltd.
• Any dispute whatsoever arising under or in connection with the above said offer shall be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996 and all proceedings shall be conducted in English only. The place of Arbitration shall be Mumbai only.
• The courts of Mumbai shall have the exclusive jurisdiction to try and entertain the dispute between the parties.

How to claim the Diesel Upgrade Offer?

• All customers who get the Offers need to carry the following with him/her at the time of collection of the Offer:
• ‘Offer Acceptance Document’ including booking id, jointly signed by Participant for acceptance and duly signed and stamped by Tata-Fiat Dealership for physical authentication / verification.
• Self attested copy of following documents for the purpose of taxation and legal validation:
• Copy of PAN Card – Income Tax Permanent Account Number
• Photo Identity proof
• Address proof
• Bank account details
• Challan Copy of TDS deposited into bank by customer, if any.
• Any other document as may be required.
• Taxes as per prevailing laws and regulations will be applicable and the tax amount will be deducted at source and shall have to be borne by the participants.
